These Terms and Conditions govern the logistics and freight services provided by 5999Cargo Group (“5999Cargo”, “we”, “us”), including ocean, air, customs, warehousing, and related operational services.

1. Definitions

  • Client: Any individual or legal entity requesting or contracting services.
  • Shipment/Cargo: Goods transported on behalf of the Client.
  • Carrier: Third-party shipping line, airline, or ground transporter.
  • Services: Ocean Freight, Air Solutions, customs support, warehousing, personal shopper, drop shipping, and related services.

2. Contract scope and acceptance

  1. Any quote issued by 5999Cargo is valid only for the period stated in that quote.
  2. Service engagement is deemed accepted when the Client confirms in writing, makes payment, or tenders cargo for execution.
  3. Unless expressly agreed otherwise, 5999Cargo acts as a logistics operator/coordinator and may involve third-party providers.

3. Transit times and availability

  • Transit times are estimates and may vary due to space availability, weather, port/airport congestion, inspections, and government controls.
  • Specific arrival or delivery dates are not guaranteed unless explicitly documented as guaranteed service.

4. Client obligations

The Client represents and warrants that:

  1. Shipment information, declared value, and cargo details are true and complete.
  2. All required import/export documents are accurate and valid.
  3. Dangerous, restricted, perishable, or special-handling cargo is declared in advance.
  4. Applicable origin, transit, and destination regulations are met.
  5. The Client secures cargo insurance when needed for its operation.

5. Customs, duties, and regulatory compliance

  • The Client remains responsible for duties, taxes, storage, demurrage, penalties, and any government-related charges linked to its cargo.
  • 5999Cargo may support customs processing under Client instructions, without assuming the Client’s tax obligations.
  • We may disclose or retain information/documents when legally required by authorities.

6. Rates, invoicing, and payments

  1. Rates include only items explicitly listed in the quote/invoice.
  2. Fuel, security, peak season, inspection, and third-party surcharges may change.
  3. Payment default may result in service suspension and/or cargo hold rights where legally permitted.
  4. Overdue balances may accrue interest and collection costs as allowed by law and contract.

7. Cargo insurance

  • Insurance is not included unless explicitly stated.
  • We recommend insurance for high-value or sensitive cargo.
  • Coverage limits and deductibles are governed by the policy issued.

8. Limitation of liability

  1. Where liability applies, 5999Cargo’s responsibility is limited to proven direct damages and applicable legal limits.
  2. We are not liable for loss of profits, market loss, reputational damage, or indirect/consequential damages.
  3. Carrier-, authority-, or force majeure-related events are subject to third-party contracts and applicable regulations.

9. Force majeure and external events

We are not responsible for delays or non-performance caused by events beyond reasonable control, including:

  • natural disasters,
  • labor disruptions,
  • war or civil unrest,
  • third-party system failures,
  • port/airport closures,
  • acts of government.

10. Claims and incidents

  1. Claims must be submitted in writing with supporting evidence and documents.
  2. The Client must report shortages/damages as soon as possible after delivery or incident detection.
  3. Claims against carriers may require third-party-specific forms and timelines.

11. Suspension or termination

5999Cargo may suspend or terminate services due to:

  • payment breach,
  • regulatory or reputational risk,
  • false shipment information,
  • breach of these Terms.

12. Intellectual property and website use

Website content, trademarks, and visual assets are owned by 5999Cargo or its licensors and may not be used without authorization.

13. Governing framework and dispute resolution

These Terms are interpreted under international trade and logistics principles together with the laws applicable to the contracted service. Parties will first seek good-faith direct resolution and, if unresolved, apply the dispute mechanism defined in the relevant service agreement.
